4 groups of retired military officers are not entitled to nursing care

The Lao Dong Newspaper Legal Consulting Office replied:

Article 3, Decree 343/2025/ND-CP stipulating the regime of nursing care and care when suffering from serious illnesses, the regime of information and funeral support when passing away for retired military officers (effective from January 1, 2026), stipulates the subjects not applicable as follows:

1. Retired military officers are subject to Decision No. 205/2004/QD-TTg dated December 10, 2004 of the Prime Minister on the implementation of a number of policies and regimes for senior officers.

2. Retired military officers are being detained; serving their prison sentences; being convicted of one of the crimes of violating national security; being removed from all positions in the Party or expelled from the Party or having all held positions or having their military titles revoked.

3. Army officers before retirement who violate discipline and law will be imprisoned; sentenced to one of the crimes of violating national security; removed from all positions in the Party or expelled from the Party or have all held positions or have their military titles revoked.

4. Retired military officers residing abroad (including those who are enjoying the regime and policies prescribed in this Decree and then residing abroad).

Thus, from 2026, the above-mentioned groups of retired military officers will not enjoy the social security regime.
