Dossiers and deadlines for approving civil servant positions are based on Decree No. 361/2025/ND-CP.

Article 5 of Decree No. 361/2025/ND-CP stipulates the approval of civil servant positions as follows:

1. The agency using civil servants prepares a dossier requesting approval of the job position of its agency, sends it to the advisory body on personnel organization of the competent authority approving the job position for review and synthesis. The dossier includes:

a) Document requesting approval of the job position;

b) List of job positions used in agencies and organizations;

c) Job description, capacity framework of each job position;

d) Propose the proportion of civil servants arranged according to each job position.

2. The personnel organization advisory agency of the competent authority approving the job position is responsible for reviewing and summarizing and submitting to the competent authority approving the job position for consideration and decision.

In case when receiving the dossier requesting job position approval but the composition does not meet the regulations in Clause 1 of this Article, within 3 working days, the staff organization advisory agency has a written request for the civil servant use agency to complete the dossier according to regulations.

3. Within 30 working days from the date of receiving sufficient dossiers requesting job position approval, the advisory body on personnel organization must complete the review, synthesis, and report to the competent authority approving the job position for consideration and decision. The review content includes:

a) The suitability of the list of job positions is determined compared to the functions and tasks of agencies and organizations according to the regulations of competent authorities;

b) The suitability of the job description, capacity framework for each job position compared to the functions, tasks, management scale, nature, and task requirements of the agency using civil servants;

c) The proportion of civil servants to be arranged according to each job position.

4. Within 10 working days from the date of receiving the written report from the advisory body on personnel organization, the competent authority approving the job position issues a decision approving the list of job positions of the agency using civil servants, and at the same time sends it to the Ministry of Home Affairs for general synthesis and monitoring.
