Rights of business management officials to commercialize scientific research results

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 4, Article 12, Decree 271/2025/ND-CP (effective from October 15, 2025) Regulating the establishment and participation in the establishment of enterprises, participating in contributing capital to enterprises to commercialize the results of scientific research and technology development in Hanoi City, stipulates the rights of civil servants and public employees in management when participating in management, operation, and work at enterprises, including:

a) Receive salaries, bonuses and allowances that are not lower than the current level of management civil servants and public employees;

b) To be assigned by public agencies to participate in management, operation, work and enterprises where civil servants work to ensure full rights of civil servants, including training, fostering, planning, appointment, salary increase, assessment, classification, reward, and discipline;

c) To be assigned a suitable job when the term of office of management, operation, or work at an enterprise expires. The regime and policies are not lower than the time when the civil servant or management official is assigned to participate in management, operation, and work at the enterprise.

Thus, civil servants and management public employees participating in managing and operating enterprises to commercialize scientific research results have the rights according to the above regulations.
