Regulations on the retirement date in 2026 for employees
The retirement date in 2026 for employees is based on the Government's decree.
Pursuant to Article 3 of Decree 135/2020/ND-CP, Clause 2 expires because Point c, Clause 2, Article 44 of Decree 158/2025/ND-CP stipulates:
Retirement date and pension regime
1. The retirement date is the end of the last day of the month of retirement age according to regulations.
In the case of employees continuing to work after reaching the prescribed retirement age, the retirement date is the time to terminate the labor contract.
3. In case the employee's profile does not determine the date and month of birth but only the year of birth, the date of January 1 of the year of birth will be used as the basis for determining the retirement date and pension benefits.
Thus, the retirement date in 2026 for employees eligible for retirement is the end of the last day of the month of retirement age according to regulations.
In the case of employees continuing to work after reaching the prescribed retirement age, the retirement date is the time to terminate the labor contract.
At the same time, in case the employee's profile cannot determine the date and month of birth but only the year of birth, the 1st of January of the year of birth will be used as the basis for determining the time of retirement and the time of pension benefits.
