Regulations on compensation when trees break or fall, causing damage to people or property

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 3, Article 28, Decree 258/2025/ND-CP (effective from October 9, 2025) stipulates the case of broken trees that cause damage to people or property as follows:

a) Organizations and individuals (including livestock grazing cages) that break or cause trees to fall must compensate organizations, individuals, families with damaged people or property according to the provisions of the Civil Code and other relevant legal provisions;

b) The unit performing the tree management service is responsible for compensating the organization, individual, or family with damaged people or property in accordance with the provisions of law in case of failure to comply with the tree management and maintenance procedures approved by competent authorities;

c) The unit providing the tree management service or the person causing the damage is not responsible for compensation for damages in case the tree is broken or fallen due to force majeure events or completely due to the fault of the damaged party.

Thus, from October 9, 2025, in case of broken trees or fallen trees causing damage to people or property, compensation will be handled as above.
