Point h, Clause 1, Article 2 of Decree 154/2025/ND-CP stipulates the subjects of staff streamlining policy as follows:
h) In the year immediately preceding or in the year of staff streamlining consideration, having a total number of working days off due to illness equal to or higher than 200 days, with confirmation from the Social Insurance agency paying sickness allowance according to current regulations of law; in the year immediately preceding or in the year of staff streamlining consideration, having a total number of working days off equal to or higher than the maximum number of working days off due to illness according to the provisions of law on social insurance, with confirmation from the Social Insurance agency paying sickness allowance according to current regulations of law, individuals voluntarily implement staff streamlining and are agreed by the agency, organization, unit directly managing.
Article 1 of Decree 154/2025/ND-CP stipulates the scope of regulation as follows:
This Decree stipulates the subjects, principles, policies for streamlining staff and responsibilities for implementing streamlining staff in agencies, organizations, and public non-business units of the Party, State, Vietnam Fatherland Front, and socio-political organizations from central to commune levels.
Thus, only those who work in agencies and units as prescribed in Article 1 of Decree 154/2025/ND-CP, and must have sick leave days as prescribed in Point h, Clause 1, Article 2 of Decree 154/2025/ND-CP are eligible to implement policies and enjoy staff streamlining regimes as prescribed by Decree 154/2025/ND-CP.
