Can surgery on the double eye be covered by social insurance under the category of illness?
Mr. Ngo Anh Tuan (Hanoi) had surgery on both near-term eyes and had a 3-day social insurance leave. Mr. Tuan wants to ask if such a near-term eye surgery can apply for social insurance under the category of illness?
Hanoi Social Insurance answers as follows:
Pursuant to Clause 1, Article 25 of the Law on Social Insurance 2014, the conditions for enjoying sick leave benefits for employees participating in social insurance are: "If you are sick or have an accident but not a work accident, you must quit your job and have confirmation from a competent medical examination and treatment facility as prescribed by the Ministry of Health".
The dossier for sick leave benefits for sick employees includes:
- In case of inpatient treatment: Discharge certificate.
- In case of outpatient treatment: Certificate of leave to receive social insurance or a discharge letter prescribed by a doctor or medical staff to provide additional leave after the inpatient treatment period.
Components of sick leave records
- For employers: For example, form 01B-HSB
- For employees: Providing documents to employers
Employees submit documents to the unit within 45 days from the date of return to work. The unit will complete the procedures within 10 days from the date of receipt of the documents to the social insurance agency.
Thus, comparing the above regulations, if the employee's medical record clearly states refractive surgery (myopia) and provides complete records according to regulations, the employee will be entitled to sick leave.
