Taking advantage of adopting children to exploit labor, how to be punished?

Clause 3 and Point c, Point d, Clause 5, Article 48 of Decree No. 109/2026/ND-CP stipulating penalties for administrative violations in the fields of judicial support; judicial administration; marriage and family; civil judgment enforcement; recovery, destruction of enterprises, cooperatives (effective from May 18, 2026) stipulates the act of violating regulations on adoption as follows:

3. A fine of between VND 5,000,000,000 and VND 10,000,000,000 shall be imposed for one of the following acts:

a) Buying, coercing, threatening or performing other illegal acts to obtain the consent of the person who has the right to consent to adoption of children;

b) Taking advantage of giving, receiving or introducing children as adopted children for personal gain, except for the cases specified in point c of this clause;

c) Taking advantage of the adoption to exploit the labor of adopted children.

5. Remedial measures:

c) Forcing the return of illegal profits obtained from the act of violating the provisions of point b, clause 2, point b and point c, clause 3 of this Article;

d) Being forced to bear all costs for medical examination and treatment and other costs (if any) due to the act of violating the provisions of point c, clause 3 of this Article.

Thus, from May 18, 2026, people who take advantage of the adoption to exploit the labor of their adopted children may be fined from 5,000 VND to 10,000 VND and forced to implement remedial measures according to the above regulations.
