The number of departments under the People's Committee at the commune level has new points from January 1, 2026
The regulation on the number of departments under the People's Committee at the commune level has new points from January 1, 2026.
Decree 370/2025/ND-CP (effective from January 1, 2026) amends and supplements Article 16 of Decree 150/2025/ND-СР stipulating the number of departments under the People's Committees at the commune level as follows:
- Based on the groups of sectors and fields specified in Article 15 of this Decree and the criteria for classifying administrative units, population size, natural area, development level, socio-economic conditions, decentralization, decentralization between local government levels and specific factors of each type of administrative unit, the Provincial People's Committee decides on the number framework and names of specialized departments applied to commune-level administrative units under its management, ensuring that it does not exceed the average of 4.5 organizations (including: specialized departments and Public Administration Service Centers) on 1 commune-level administrative unit; Hanoi City and Ho Chi Minh City alone must ensure that it does not exceed the average of 4.7 organizations (including: specialized departments and Public Administration Service Centers) on 1 commune-level administrative unit.
- The decision to establish specialized departments is decided by the local government at the commune level. In case the commune-level administrative units do not establish a specialized department, arrange specialized civil servants to advise and assist the People's Committees at the commune level in state management of the sectors and fields according to regulations.
- Public Administration Service Centers under the People's Committees at the commune level shall comply with Government regulations.
Previously, Article 16 of Decree 150/2025/ND-СР stipulated the number of departments under the People's Committees at the commune level as follows:
- Pursuant to the provisions of Article 15 of Decree 150/2025/ND-СР and the requirement for state management of sectors and fields in localities, local authorities at the commune level decide on the establishment of specialized departments.
- Public Administration Service Centers under the People's Committees at the commune level shall comply with Government regulations.
