The People's Council of the commune decides on the staffing of commune-level cadres and civil servants

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 21 of the Law on Organization of Local Government 2025 stipulates the duties and powers of the People's Councils of communes in the field of organizing the apparatus and building the government as follows:

a) Decision to establish, reorganize, change the name, and dissolve other specialized agencies and administrative organizations under the People's Committee at the same level according to the provisions of law;

b) Based on the targets assigned by the local government at the provincial level, specifically deciding on the staffing of cadres and civil servants in the agencies of the local government at their level, the number of employees receiving salaries from the state budget in public service units under their management in the area;

c) Consider and give opinions on the establishment, dissolution, merger, division of administrative units, adjustment of boundaries and renaming of administrative units at their level;

d) Decision to establish, reorganize, dissolve, name, and rename villages according to the provisions of law; specifically decide on the number of non-professional workers receiving allowances from the state budget in the area according to the regulations of local authorities at the provincial level;

d) Issue Working Regulations of the People's Council, Standing Committee of the People's Council, Committees of the People's Council, People's Council Delegation Group and People's Council delegates at their level;

e) Elect, dismiss, or remove Chairman, Vice Chairman of the People's Council, Head of the Committee of the People's Council at his or her level, Chairman, Vice Chairman, or member of the People's Committee at the same level;

g) Remove People's Council delegates and approve the People's Council delegates at their level to cease their delegation duties according to the provisions of law.

Thus, based on the targets assigned by the local government at the provincial level, the People's Council of the commune shall decide specifically on the staffing of cadres and civil servants in the agencies of the local government at its level according to the above regulations.
