Conditions and standards for individuals to be allowed to sign contracts to perform civil servant duties
Conditions and standards for individuals who are allowed to sign contracts to perform civil service duties are based on Decree No. 173/2025/ND-CP.
Decree No. 173/2025/ND-CP stipulates labor contracts and service contracts to perform one or a number of tasks of civil servants in Party agencies, the Vietnam Fatherland Front, the State, and socio-political organizations at the central, provincial, and commune levels.
Clause 2, Article 9 of the Decree stipulates the standards and conditions for individuals who are allowed to sign labor contracts and service contracts to perform civil servant duties as follows:
a) Have expertise suitable for the job that requires signing a contract; have a clear background, good ethics; be healthy enough to work; be dedicated to work; have capacity, practical experience; be eligible to sign a contract, participate in work of an agency, organization or unit according to the provisions of law;
b) Not subject to criminal prosecution or prison sentence enforcement but subject to suspended sentences, non-custodial reform or being subject to educational measures in communes and wards; sent to compulsory education institutions and sent to compulsory drug rehabilitation facilities; people who have lost their capacity to act, limited administrative capacity, not subject to a period of being banned from practicing or banned from doing work related to contract signing;
c) Meet other standards and conditions as prescribed by specialized laws and as prescribed by competent authorities to sign contracts (if any).
