Assessing and classifying the quality of civil servants subject to party discipline and administrative discipline
A reader with email thuvanxxx@gmail.com asked: How is the assessment and classification of the quality of civil servants subject to party discipline and administrative discipline regulated?
The Lao Dong Newspaper Legal Consulting Office replied:
Clause 3, Article 11, Decree 335/2025/ND-CP on quality assessment and classification for state administrative agencies and civil servants (effective from January 1, 2026), stipulates that civil servants subject to party discipline or administrative discipline are assessed and classified as follows:
a) Civil servants subject to party discipline or administrative discipline in the year of assessment due to degradation in political ideology, ethics, lifestyle, and violations related to public service activities shall be classified as not completing their tasks.
In case of being disciplined by party discipline and administrative discipline for the same violation but the decision to discipline the party and the decision to discipline administrative discipline is not effective in the same assessment year, it will only be counted as a basis for classifying quality in one assessment year.
b) In case of violation and there is no disciplinary action decision from the competent authority but it has been used as a basis for classifying quality to the level of not completing the task in the assessment year, the decision to handle the disciplinary action issued after the assessment year for that violation (if any) shall not be counted as a basis for classifying quality in the year of the decision to handle the disciplinary action.
c) In case a civil servant has shortcomings or violations occurring in the old organization but is disciplined and enforced in the newly transferred organization, it will be included in the assessment and classification results of the old organization.
d) In case a civil servant has shortcomings or violations occurring in both the old and new organizations, is disciplined and enforced in the old and newly transferred organizations, the form of discipline shall be included in the assessment and classification results according to the time of determination of the violation at each organization.
Thus, from January 1, 2026, the assessment and classification of the quality of civil servants subject to party discipline and administrative discipline are regulated as above.
