Cases of not reappointing, prolonging leadership and management time with civil servants

Clause 3, Article 16 of Decree 300/2026/ND-CP (effective from August 1, 2026) stipulates the amendment and supplementation of Article 36 of Decree No. 170/2025/ND-CR stipulating cases where the process of reappointing and extending the term of leadership and management positions has not been carried out as follows:

a) Belonging to one of the cases specified in points b, d, clause 9, Article 29 of this Decree;

b) Being in the period of being sent by competent agencies and organizations to study and work abroad for 03 months or more;

c) Being inpatient for 03 months or more at medical facilities or being on maternity leave;

d) Having information exchanged by functional agencies about personal responsibility in cases, incidents, conclusions that functional agencies have been, are investigating, inspecting, and checking but have not yet had official conclusions or have requests from competent agencies to consider and handle personal responsibility but have not yet had official conclusions;

e) Belonging to other cases that have not been considered for reappointment, extending the term of office according to the regulations of the competent authority.

4. Decisions on reappointment or decisions to extend the term of leadership and management positions must be issued at least 01 working day before the expiration date of the appointment.

In case for objective reasons, the time of signing the decision to reappoint or the decision to extend the term of leadership and management positions after the expiration date of appointment, the term of appointment of the new decision is calculated from the expiration date of the old decision and must be clearly stated in the decision.

Thus, from August 1, 2026, cases that have not implemented the process of reappointing and extending the term of leadership and management positions for civil servants will be implemented according to the above regulations.
