Early retirement regime for civil servants of public service units when leaving the district level
The early retirement regime for civil servants of public service units when leaving the district level is guided according to Official Dispatch 2340 of the Ministry of Home Affairs.
Section 2 of Official Letter 2034/BNV-TCBC in 2025 has instructions on implementing the early retirement regime as follows:
2. For commune-level administrative units kept unchanged (not reorganized)
a) Commune -level administrative units maintain the status quo (not arranged) all have the reception of functions and tasks from the district level and receive tasks according to decentralization from the provincial level; At the same time, receiving cadres and civil servants from the provincial and district levels, together with commune -level officials and public employees to arrange according to the new commune -level government model. Accordingly, cadres and civil servants are expected to work in new communes, which are all subject to the direct impact of the organization and organization of the apparatus and subjects applied according to Decree No. 178/2024/ND-CP of December 31, 2024 (amended and supplemented in Decree No. 67/2025/ND-CP of March 15, 2025).
b) Public service units managed by districts and reorganized to new commune-level administrative units, civil servants and employees working in these public service units are directly affected by the implementation of organizational restructuring and are subject to Decree No. 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025).
c) Public service units managed by districts and converted to commune level management, civil servants and employees working in these public service units are not directly affected by the reorganization of the apparatus and are not subject to Decree No. 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025). Accordingly, these public service units will streamline the payroll, restructure and improve the quality of the civil servant team, civil servants are subjects of application according to Decree No. 178/2024/ND-CP dated December 31, 2024 (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025), not including civil servants in education and health.
Thus, according to Official Dispatch 2340 of the Ministry of Home Affairs, civil servants of public service units who are dismissed from the district level are entitled to early retirement in the following cases:
- Public service units managed by districts, reorganized according to the new commune-level administrative units:
Officials in these public service units are the subjects directly affected by the implementation of the organizational arrangement and are subject to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP.
- Public service units managed by districts, converted to the status quo commune level:
Officials working in these public service units are not directly affected by the reorganization of the apparatus and are not subject to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP.
These public service units will streamline the payroll, restructure and improve the quality of civil servants, civil servants are subjects of application according to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP, not including civil servants in education and health.
