Confiscation of vehicles violating traffic laws, beautiful license plates will also be revoked
The lawyer said that the vehicle owner must not keep the license plate in cases where the vehicle is confiscated due to violation of traffic safety laws.
Recently, the Traffic Police of Ho Chi Minh City Police have drawn up a record and confiscated the SH vehicle with license plate 60C1-567.89 driven by M.A. The question is, is confiscation of a vehicle accompanied by confiscation of a license plate, especially a beautiful license plate that has been purchased through auction?
Lawyer Nguyen Van Hau - Head of the Communications Agency of the Vietnam Bar Federation - said that according to the provisions of Point a, Clause 11, Article 7 of Decree 168/2024/ND-CP, a person who commits the following acts will have his vehicle confiscated: Letting go of both hands while driving; using his feet to control the vehicle; sitting on one side to control the vehicle; lying on the saddle to control the vehicle; changing the driver while the vehicle is running; turning the person behind to control the vehicle or driving blindfolded.
However, there are currently no specific regulations on confiscating vehicle license plates when violating the law in traffic control.
Currently, only Point d, Clause 3, Article 3 of Circular 79/2024/TT-BCA stipulates that "In case the vehicle has expired, is damaged and cannot be used or the vehicle ownership is transferred, the vehicle owner's identification plate will be revoked by the vehicle registration agency and the license plate number will be retained for the vehicle owner for a period of 05 years to reissue when the vehicle owner registers another vehicle under his/her ownership (except in cases of transfer, exchange, donation, inheritance of the vehicle associated with the auctioned vehicle license plate).
After 05 years from the date of revocation, if the vehicle owner has not registered, the license plate number will be transferred to the license plate warehouse for registration and issuance to another organization or individual according to regulations".
Lawyer Nguyen Van Hau also said that in cases where vehicles are confiscated due to administrative violations, it is a coercive measure, applied to exhibits and means of violation with particularly dangerous behavior to society.
When the vehicle is confiscated according to the decision to sanction administrative violations, all violating vehicles, including the vehicle, vehicle registration and license plate, will be revoked for handling according to regulations.
