Time to receive pension for part-time commune-level cadres
The pension payment period for non-professional commune-level cadres is stipulated in the Social Insurance Law 2024, effective from July 1, 2025.
Article 69 of the Law on Social Insurance 2024 stipulates the time of pension as follows:
1. The time to receive pension for subjects specified in Points a, b, c, d, dd, e, i, k and l, Clause 1 and Clause 2, Article 2 of this Law who are participating in compulsory social insurance is the time when they are eligible for pension according to regulations and is recorded in the document of the employer determining the termination of the labor contract or determining the termination of employment.
2. The time to receive pension for subjects specified in Points g, h, m and n, Clause 1, Article 2 of this Law and those who are reserving social insurance payment period is the time to qualify for pension according to regulations and is stated in the employee's request document.
3. The Minister of Labor, War Invalids and Social Affairs (now the Ministry of Home Affairs) shall specify in detail this Article; prescribe the time of pension for cases specified in Clause 7, Article 33 of this Law; prescribe the calculation and determination of conditions for each case to resolve pension regimes.
Thus, the pension receiving time for non-professional cadres at the commune level participating in compulsory social insurance is the time when they are eligible for pension according to regulations and is recorded in the employer's document determining the termination of labor contracts or determining the termination of employment.
