Regulations on public asset procurement at public service units

The Lao Dong Newspaper Legal Consulting Office replied:

Article 41 of Decree 186/2025/ND-CP (effective from July 1, 2025) stipulates the procurement of public assets at public service units as follows:

1. The purchase of public service establishments and other public assets is applied in the cases specified in Clause 1, Article 52 of the Law on Management and Use of Public Assets, including the case of purchase to replace assets that meet the conditions for liquidation according to regulations.

2. Based on the assigned budget estimate scope and the permitted funding sources, public service units organize the procurement of public assets according to the provisions of the law on bidding, without having to submit to issue a Purchase Decision.

The organization of the procurement of public assets by centralized methods is carried out in accordance with the provisions of the law on bidding and the provisions of Chapter VI of this Decree.

3. The procurement of assets specified in this Article does not include the procurement of services serving the operations of public service units. The procurement of services for the operation of public service units is carried out in accordance with the provisions of relevant laws.

Thus, the procurement of public assets at public service units is regulated according to the above regulations.
