Regulations on converting military area land to serve people's needs

Clause 2, Article 3 of Decree No. 213/2025/ND-CP stipulates the order and procedures for converting the purpose of using national defense works and military zones for socio-economic development and serving the needs of the people as follows:

2. For military areas:

a) In case the land area of the military zone is subject to the national defense land use plan transferred to the locality approved by the Prime Minister; within 30 days from the date of receipt of the valid dossier as prescribed in Clause 1, Article 4 of this Decree, the Ministry of National Defense shall send a document to the ministry, branch or locality regarding the agreement or non-agreement to change the purpose of use; in case the Ministry of National Defense does not agree to change the purpose of use, the provincial People's Committee shall be responsible for reporting to the Prime Minister for consideration and decision;

b) In case the land area of the military area is not included in the national defense land use plan transferred to the locality approved by the Prime Minister; the conversion of the land use purpose of the military area and the recovery of national defense land shall comply with the provisions of the law on land;

c) The land area of a military area specified in Points a and b of this Clause must be updated after changing the purpose or reclaiming when reviewing and adjusting the planning according to the provisions of law.

Thus, the regulations on converting military area land for socio-economic development and serving the needs of the people are implemented as above.
