Article 36 of this Law stipulates the election of positions of People's Councils and People's Committees as follows:

1. The People's Council elects the Chairman of the People's Council, Vice Chairman of the People's Council, Head of the People's Council Committee among the People's Council delegates according to the list of nominations for individual positions of the Standing Committee of the People's Council.

The People's Council elects the Chairman of the People's Committee according to the recommendation of the Chairman of the People's Council; elects the Vice Chairman of the People's Committee, members of the People's Committee according to the recommendation of the Chairman of the People's Committee. Members of the People's Committee do not necessarily have to be People's Council delegates.

3. The results of the election of Chairman of the People's Council and Vice Chairman of the Provincial People's Council must be approved by the National Assembly Standing Committee; the results of the election of Chairman of the People's Council and Vice Chairman of the People's Council at the commune level must be approved by the Standing Committee of the Provincial People's Council.

4. The results of the election of the Chairman of the People's Committee and Vice Chairman of the Provincial People's Committee must be approved by the Prime Minister; the results of the election of the Chairman of the People's Committee and Vice Chairman of the Commune People's Committee must be approved by the Chairman of the Provincial People's Committee.

Within 5 working days from the date of election of Chairman of the People's Council, Vice Chairman of the People's Council, Chairman of the People's Committee, Vice Chairman of the People's Committee, Standing Committee of the People's Council must send the election results to competent authorities and individuals for approval according to the provisions of Clause 3 and Clause 4 of this Article. Within 10 working days from the date of receipt of the election results, the competent agency or person must review and approve; in case of non-approval, a written response must be given, stating the reason and requesting the People's Council to re-elect the position not to approve.
