The person responsible for recovering the money for streamlining the payroll according to Decree 154
Responsibility for recovering staff streamlining money when implementing staff streamlining in violation of regulations is based on Decree 154.
Decree 154/2025/ND-CP takes effect from June 16, 2025, replacing Decree 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining.
The regimes and policies stipulated in Decree 154/2025/ND-CP are applied until December 31, 2030.
Clause 6, Article 13 stipulates the responsibilities of Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, heads of organizations established by the Government and the Prime Minister but not public service units as follows:
In case the staff streamlining is not implemented in accordance with regulations, the budget for staff streamlining will be recovered, the decisions to resolve staff streamlining will be revoked and those who are not subject to staff streamlining will be allowed to return to work.
Along with that, Point b, Clause 2, Article 14 of Decree 154/2025/ND-CP stipulates as follows:
For the Chairman of the Provincial People's Committee, in case the staff streamlining is not implemented in accordance with regulations, the budget for staff streamlining will be recovered, decisions on staff streamlining will be revoked and those who are not subject to staff streamlining will be assigned to return to work; at the same time, consider handling the responsibilities of relevant agencies, organizations, units and individuals and be responsible according to the provisions of law for not implementing regulations on staff streamlining.
Thus, the responsibility for recovering the staff streamlining fee of cadres, civil servants, public employees and non-professional workers in Decree 154 belongs to the Chairman of the Provincial People's Committee, Ministers, Heads of ministerial-level agencies, Heads of Government agencies, heads of organizations established by the Government and the Prime Minister that are not public service units.
