Penalties for giving people with expired driving licenses to rent cars to drive on their own
A reader with email thuvanxxx@gmail.com asked: How can businesses that rent vehicles to people with expired driving licenses for self-driving be fined?
The Lao Dong Newspaper Legal Consulting Office replied:
Article 15, Decree 336/2025/ND-CP on administrative sanctions for violations in road operations (effective from March 1, 2026), on penalties for violations of vehicle rental services as follows:
1. Fines from VND 8 million to VND 10 million for individuals, from VND 16 million to VND 20 million for vehicle rental service organizations that violate the act of not signing a vehicle rental contract to self-drive with the lessee.
2. Fine from 10 million VND to 15 million VND for individuals, from 20 million VND to 30 million VND for vehicle rental service organizations that commit one of the following violations:
a) Arrange a driver for a renter to drive on his/her own;
b) Not signing a self-drive vehicle rental contract with the lessee for automobile and internal transportation business;
c) Signing a vehicle lease contract for automobile and internal transportation business without showing the content without the driver with the lessee.
3. Fines from VND 28 million to VND 30 million for individuals, from VND 56 million to VND 60 million for vehicle rental service businesses that violate the lease of vehicles when the lessee rents a vehicle for self-drive without a valid driving license with points, suitable for the type of vehicle for rent.
Thus, from March 1, 2026, a business that leases a vehicle to a person with an expired driver's license to self-drive can be fined up to 60 million VND.
