A reader with email hoanhixxx@gmail.com asked: How do civil servants and public employees who are temporarily suspended from work pay health insurance?
The Lao Dong Newspaper Legal Consulting Office replied:
Point g, Clause 1, Article 6 of Decree No. 188/2025/ND-CP stipulates the contribution rate, payment support level and responsibility for health insurance payment as follows:
For employees who are officials, civil servants, and public employees who are temporarily detained, temporarily detained, temporarily suspended from work, or temporarily suspended from their positions without being disciplined, the monthly contribution rate shall be 4.5% of the 50% of the monthly salary used as the basis for compulsory social insurance payment of employees in the month immediately preceding the detention, temporary detention, or temporary suspension according to the provisions of law, in which the employer shall pay 2/3 and the employee shall pay 1/3.
In case the competent authority concludes that there is no violation of the law, the employer and the employee must pay health insurance on the retained salary.
Thus, civil servants and public employees whose work is temporarily suspended shall pay health insurance according to the above regulations.
