Pregnant female teachers cannot be mobilized
A reader with email loannguyenxxx@gmail.com asked: If a teacher is pregnant, can he be transferred?
The Lao Dong Newspaper Legal Consulting Office replied:
Clause 3, Article 17 of the Law on Teachers (effective from January 1, 2026) stipulates cases of non-transfermentation including:
a) Female teachers who are pregnant or raising children under 36 months old; teachers in particularly difficult circumstances; teachers whose spouses are being mobilized, seconded or assigned to work in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions.
The transfer of teachers is still carried out for the subjects specified in this point if the teacher wishes to be transferred;
b) Teachers who have not yet transferred their positions according to the provisions of the law on corruption prevention and control and other relevant legal provisions.
4. The Government stipulates in detail the authority and subjects for teacher mobilization; stipulates the reservation of regimes and policies in teacher mobilization.
Thus, from January 1, 2026, pregnant female teachers cannot be mobilized unless the teacher wishes to be mobilized.
