If the company fails to pay enough unemployment insurance, it will be sued by workers
From January 1, 2026, employees have the right to sue businesses if they do not pay enough unemployment insurance.
The Government has just issued Decree 374/2025/ND-CP detailing a number of articles of the Law on Employment on unemployment insurance (effective from January 1, 2026).
According to Article 6 of this Decree, which stipulates the responsibility for paying unemployment insurance, when terminating labor contracts, employment contracts or terminating employment, employers must pay the full amount of unemployment insurance according to regulations for employees to promptly resolve unemployment insurance regimes for employees.
In case the employer does not pay enough unemployment insurance for the employee, the employee has the right to sue the employer to the competent Court within 03 months from the date of termination of the labor contract or employment contract to request the settlement of benefits related to unemployment insurance according to the provisions of law.
The subjects of application according to the provisions of Decree 374/2025/ND-CP are employees and employers who are required to participate in unemployment insurance as prescribed in Article 31 of the Law on Employment.
