When must the People's Committees at the commune level be responsible for reporting serious work-related accidents
Commune-level People's Committees must be responsible for reporting serious labor accidents when implementing the 2-level local government model.
Article 44 of Decree 129/2025/ND-CP (effective from July 1, 2025) stipulates statistics and reports on occupational accidents and technical incidents that cause serious occupational safety and hygiene problems.
Accordingly, the statistics and reporting of occupational accidents and technical incidents causing serious unsafety and occupational hygiene are implemented as follows:
The People's Committee at the commune level shall compile statistics and report work accidents and technical incidents causing serious unsafety and occupational hygiene to state management agencies on provincial-level internal affairs according to regulations.
According to Article 47 of Decree 129/2025/ND-CP, reporting on occupational accidents as prescribed in Clause 2, Article 24 of Decree No. 39/2016/ND-CP is implemented as follows:
The People's Committee at the commune level reports to the Department of Home Affairs on labor accidents, technical incidents causing serious unsafety and occupational hygiene related to workers working without labor contracts that occur in the area according to regulations.
Previously, the responsibility for this report was mainly carried out by enterprises and the Department of Labor, War Invalids and Social Affairs according to Decree 39/2016/ND-CP.
