Electronic labor contracts and regulations on connection and data sharing according to Decree 337
Decree 337/2025/ND-CP has just issued regulations on electronic labor contracts.
In particular, regulations on connecting and sharing data with the Electronic Labor Contract Platform are based on Article 16.
Article 16. Connecting and sharing data with the Electronic Labor Contract Platform
1. National database, specialized database, National Data Center, public service portal, information system for handling administrative procedures, platform for integrating and sharing data at the ministerial and provincial levels and other information systems of state agencies, other databases connected to the Electronic Labor Contract Platform via telecommunications network, Internet, computer network, information system according to the provisions of law on connection and sharing of data and open data to serve electronic transactions of state agencies.
2. To ensure information security, security, safety, and personal data protection when connecting and sharing information with the Electronic Labor Contract Platform, the information system of State agencies and organizations must ensure the following requirements:
a) Meet information technology standards and regulations in connection and sharing with the Electronic Labor Contract Platform.
b) Ensure information security at least level 3 according to the provisions of law on ensuring information system security according to level when officially connected.
3. The connection and sharing of data as prescribed in Clause 1 of this Article is carried out on the basis of agreed in writing between the Ministry of Home Affairs and the agency or organization in charge of managing the database and information system.
4. The Ministry of Home Affairs is responsible for notifying in writing the refusal or temporary suspension of connection and data sharing in the Electronic Labor Contract Platform in the following cases:
a) The information system of the agency or organization proposing the connection does not ensure the conditions specified in Clause 2 of this Article.
b) Connected agencies and organizations that illegally access, change, delete, cancel, or disseminate information in the Electronic Labor Contract Platform.
c) The connected agency or organization violates the regulations on personal data protection or the content agreed upon with the Ministry of Home Affairs as prescribed in Clause 3 of this Article.
