Documents for establishing social funds and charity funds from March 2026

The Lao Dong Newspaper Legal Consulting Office replied:

Article 17 of Decree 03/2026/ND-CP regulating the organization and operation of social funds and charity funds (effective from March 1, 2026) stipulates the dossier for establishing funds as follows:

The fund establishment dossier (main version), including:

1. Proposal to establish a fund (attached with appendix).

2. Draft fund charter.

3. The commitment to contribute assets to establish a fund of the Founders together with documents proving the assets contributed to establish a fund as prescribed in Article 16 of this Decree.

4. The personal records (according to the form attached to this Decree) of the Fund's founders shall not exceed 06 months from the date of submission of documents and records as prescribed in Articles 13, 14 or 15 of this Decree.

5. Documents electing the positions of the Fund's Board of Directors.

6. Documents proving legal rights to use according to the provisions of law where the fund is expected to be headquartered (oreal or certified copy).

Thus, from March 1, 2026, the dossier for establishing social funds and charity funds is regulated as above.
