Article 44 of the 2025 Construction Law (effective from July 1, 2026) stipulates the issuance of construction permits as follows:

1. Conditions for granting construction permits for types of permits specified in Clause 1, Article 43 of this Law include:

a) In accordance with the purpose of land use as prescribed by the law on land;

b) In accordance with urban and rural planning or separate urban designs according to the law on urban and rural planning or architectural management regulations according to the law on architecture or detailed planning of other sectors according to the provisions of the law on planning, except in cases of granted construction permits with a term;

c) Construction design to ensure safety for works and neighboring works; fully comply with regulations on environmental protection, fire prevention and fighting; ensure the ability to connect technical infrastructure.

2. The construction permit is granted for a term in an area with planning according to the law on urban and rural planning or detailed planning for other sectors approved and announced by a competent state agency but has not been implemented and there is no decision to reclaim land from a competent state agency.

3. The Government stipulates in detail the conditions, authority, documents, order, procedures for granting, adjusting, extending, re-granting, revoking, canceling and publicizing construction permits.

Clause 1, Article 43 of the 2025 Construction Law stipulates the general provisions on granting construction permits as follows:

1. The construction permit includes the following types:

a) New construction permit;

b) License for repair, renovation, and relocation of works;

c) Limited construction permit.

Thus, from July 1, 2026, the conditions for granting a construction permit are regulated as above.
