Conditions for receiving back people who were civil servants
A person who was a civil servant is eligible to be accepted as a civil servant if he/she meets the prescribed conditions.
Article 18 of Decree 138/2020/ND-CP is amended by Clause 11, Article 1 of Decree 116/2024/ND-CP effective from September 17. 2024 stipulates the subjects of acceptance as civil servants, specifically as follows:
Accepted as a civil servant
1.Subjects of receipt: a) Officials working at public non -business units; b) Commune -level officials and public employees; c) Persons in the people's armed forces and people working in a cipher organization but not a civil servant; d) Chairman of the Board of Members, Chairman of the Board of Directors, Chairman of the Company, Member of the Board of Members, members of the Board of Directors, Supervisors, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant and the person holding the position and position of management from the room level or higher in enterprises holding 100% of charter capital, enterprises holding over 50% of the charter capital or the value of the charter capital or the value of the charter capital or the value of the charter capital of the charter capital or the value of the charter capital or the value dd) He was once a cadre and civil servant who was later mobilized and rotated by the competent authority to be not officials and civil servants at other agencies and organizations.

Thus, a person who was a cadre or civil servant and was then transferred or rotated by competent authorities to hold positions of non-capecapecy at other agencies and organizations is the subject of being accepted as a civil servant.
