The Chairman of the People's Committee at the commune level decides to merge the kindergarten if it meets the conditions

Article 4 of Appendix I issued with Decree No. 142/2025/ND-CP dated June 12, 2025 of the Government) stipulates the order and procedures for implementing the authority to merge, divide, and separate kindergartens as follows: 1.

kindergartens are merged, divided, or separated when ensuring the requirements specified in Clause 1, Article 51 of the Law on Education.

2.The dossier includes: a) Proposal to merge, divide, or separate kindergartens (according to Form No. 04 of Appendix II attached to this Decree); b) Project to merge, divide, or separate kindergartens (according to Form No. 05 of Appendix II attached to this Decree); c) The consensus of the investor representing at least 75% of the total capital contributed for the merger, division, or separation of private kindergartens.







3.Implementation procedures: a) Organizations and individuals submit a set of documents specified in Clause 2 of this Article via the online or post-on-site public service portal or directly to the People's Committee at the commune level; b) Within 5 working days from the date of receipt of the complete documents, the People's Committee at the commune level shall notify in writing the preschools of the contents that need to be revised and supplemented in case the documents are invalid; c) Within 20 working days from the date of receipt of the complete documents, the People's Committee at the commune level shall appraise the documents and appraise the conditions for merging, dividing, and separating kindergartens (if necessary); if eligible, the Chairman of the People's Committee at the commune level shall decide on the merger, separation of kindergartens and the permission for educational activities; if not eligible, within 20 working days from the date of receipt of the complete documents, the People's Committee at the commune level shall clearly assess the conditions for merging, dividing, separating, and separating kindergartens; if eligible, the Chairman of the People's Committee at the commune level shall decide on the merger, separating, separating and separating kindergartens and separating kindergartens.







The decision to merge, divide, or separate kindergartens (according to Form No. 10, Appendix II attached to this Decree) is publicly announced in the mass media.
