Chairmen of wards and communes in Ho Chi Minh City are allowed to let civil servants resign
HCMC - The Chairman of the People's Committee of a ward or commune in HCMC has the right to decide on the termination of employment or retirement for civil servants under his management, appointment and use.
The Ho Chi Minh City People's Committee has just issued a decision to authorize a number of tasks under the authority of the Chairman of the City People's Committee for the use and management of civil servants.
According to this decision, the Chairman of the Ho Chi Minh City People's Committee authorizes the Heads of Departments, branches, sectors and the Chairmen of Commune-level People's Committees to decide on the arrangement and assignment of work to civil servants under the management of the unit, except for cases under the appointment authority of the Chairman of the City People's Committee.
Regarding the settlement of the termination and retirement regime for civil servants, the decision clearly states:
The Director of the Department of Home Affairs is authorized to decide on resignation and retirement for civil servants holding the rank of senior specialist and equivalent, except for cases under the authority of the Chairman of the Ho Chi Minh City People's Committee.
Heads of departments, branches, and the Chairman of the People's Committee at the commune level are authorized to decide on resignation and retirement for civil servants under their management, appointment and use; except for civil servants holding the rank of senior specialist and equivalent, as well as cases under the authority of the Chairman of the Ho Chi Minh City People's Committee.
The decision also clearly states the responsibilities of authorized persons. Heads of authorized agencies and units must properly perform and be responsible to the Chairman of the Ho Chi Minh City People's Committee for the implementation of authorized tasks and powers. No other individual shall be re-authorized to perform these tasks or powers. Proactively prepare and allocate sufficient resources to ensure good implementation of assigned tasks.
