Spending bonuses to officials and civil servants is the responsibility of the head

Ms. Nguyen Thi Ha (character's name has been changed, in Lang Son) said that she is working as a contract employee according to Decree 111/2022/ND-CP of the Government, signed a contract according to her expertise, skills and salary according to Decree 204/2004/ND-CP.

According to her understanding, Decree 73/2024/ND-CP of the Government stipulates bonuses for this group of subjects. However, from 2024 to present, she has not received the above bonus due to not being provided with a source; in which, the bonus source code 18 is only arranged to pay for cadres, civil servants, and public employees. This is explained that Circular 62/2024/TT-BTC does not summarize the subjects of contract workers according to Decree 73/2024/ND-CP.

According to Ms. Ha, many units have based on Circular 62/2024/TT-BTC to excluding contract workers from the eligible for compensation from source 18, and at the same time required the unit to balance the budget for payment.

Meanwhile, on the Ministry of Finance's Electronic Information Portal, there was a response that using the reward fund code 18 to pay contract workers was appropriate.

From the above reality, Ms. Nguyen Thi Ha suggested that the Ministry of Home Affairs and the Ministry of Finance soon clarify related regulations, in order to ensure the rights of contract workers, avoiding the situation where workers do not enjoy the regimes that they should have enjoyed according to regulations.

Regarding Ms. Ha's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.

On June 30, 2024, the Government issued Decree No. 73/2024/ND-CP stipulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces.

In particular, Clause 1 and Clause 2, Article 4 of this Decree stipulate the subjects implementing the bonus regime and assigning the head of the competent authority to manage or delegate the authority to manage cadres, civil servants and heads of public service units to be responsible for developing specific regulations to implement the bonus regime applicable to subjects on the salary list of the agency or unit.

The organization and implementation of policies for cadres, civil servants and public employees in Lang Son province is under the authority of the Chairman of the Provincial People's Committee.

Therefore, the Ministry of Home Affairs recommends that you contact the agency managing cadres, civil servants and public employees of Lang Son province (Department of Home Affairs) for answers.
