Cases where teachers are not allowed to be transferred

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 19 of the 2025 Law on Teachers (effective from January 1, 2026) stipulates cases that are not transferred, including:

a) Teachers undergoing disciplinary review and handling; being inspected, verified, audited, investigated, prosecuted, or tried;

b) Teachers who have not completed 03 years of service from the date of being recruited as teachers, except for cases of voluntary transfer to educational institutions in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions.

Thus, the above cases are not allowed to transfer teachers.
