In cases where people do not have to make a written request to receive social pension benefits

Clause 2, Article 7 of Decree 176/2025/ND-CP (detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social pension benefits) stipulates as follows:

The Chairman of the People's Committee at the commune level shall base on the list and records of the subjects receiving monthly social benefits to consider the decision to transfer to social pension benefits according to the provisions of this Decree. Subjects do not have to make a written request to receive social pension benefits as prescribed in Point a, Clause 1, Article 4 of this Decree.

Point a, Clause 1, Article 4 of the Decree stipulates:

1. The order and procedures for implementing social pension benefits are as follows:

a) The person applying for social pension benefits must have a written request for social pension benefits according to Form No. 01 issued with this Decree and send it directly or through a postal organization or online to the Chairman of the People's Committee of the commune, ward, or special zone under the province or city where he/she resides (hereinafter referred to as the commune level);

Thus, according to the regulations effective from July 1, 2025, social pension beneficiaries must have a written application for social pension benefits. However, in case the subject receiving monthly social allowances is considered by the Chairman of the People's Committee of the commune for decision to transfer to receiving social pension allowances, it is not necessary to make a written request to receive social pension allowances.
