Cases where unemployment insurance payment period is reserved according to the 2025 Employment Law
Article 41 of the 2025 Law on Employment stipulates the following cases of reserving unemployment insurance payment time.
According to Clause 5, Article 41 of Law No. 74/2025/QH15, employees are allowed to reserve their unemployment insurance payment period if they fall into one of the following cases:
- Have a job and are subject to compulsory social insurance according to the provisions of the Law on Social Insurance 2024;
- Performing military service, service in the People's Public Security, standing militia,
- Study for a period of over 12 months;
- Comply with the decision to apply measures to include in compulsory educational institutions and compulsory drug rehabilitation facilities;
- Declared missing by the court;
- Temporarily detained; serving a prison sentence;
- According to the employee's request.
