Adding 7 new regulations on paying Unemployment Insurance in the 2025 Employment Law
The 2025 Law on Employment takes effect from January 1, 2026, adding many new regulations on payment, lump sum payment, reduction of payment and handling of violations in unemployment insurance.
Supplementing regulations on late payment and evasion of unemployment insurance payment (Clause 5, Article33):
Employers are responsible for paying full unemployment insurance. The handling of late payment and evasion of unemployment insurance payment is carried out in accordance with the provisions of the Law on Social Insurance.
Supplementing regulations on reducing unemployment insurance premiums for employers when recruiting new and using disabled workers (Clause 6, Article):
Employers who are eligible for a reduction in unemployment insurance contributions are responsible for the employer to pay to employees with disabilities for a period of no more than 12 months when recruiting and employing employees with disabilities.
Supplementing the regulation on employers compensating employees (Clause 7, Article):
Employers are responsible for paying the full amount of unemployment insurance according to regulations for employees when terminating labor contracts, work contracts or terminating work to promptly resolve unemployment insurance regimes for employees.
In case the employer does not pay enough unemployment insurance to the employee, it must pay the corresponding amount of the unemployment insurance regimes that the employee is entitled to according to the provisions of law.
Supplementing the regulation on paying unemployment insurance for those who are paid for unemployment benefits (Clause 1, Article 34,):
In case the employee stops working and still receives a monthly salary equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions, it shall be paid according to the salary received during the period of stopping work.
Agree on the highest salary for unemployment insurance contributions (Clause 2, Article34):
Remove the regulation that the highest salary used as the basis for paying unemployment insurance is 20 times the basic salary for employees subject to the salary regime prescribed by the State in the 2013 Employment Law. The 2025 Law on Employment unifies the highest salary as the basis for paying unemployment insurance, the highest is 20 times the regional minimum monthly salary announced by the Government at the time of paying unemployment insurance.
Supplementing regulations on subjects eligible to stop paying unemployment insurance (Clause 3, Article34):
For employees participating in unemployment insurance who are detained or temporarily suspended from work, the employee and the employer shall temporarily suspend the payment of unemployment insurance; in case the employee is entitled to full salary, the employee and the employer shall compensate for the period of detention or temporary suspension of work in the amount payable for the months of suspension and shall comply with the compulsory social insurance compensation.
Supplementing regulations on the time of collection and payment of unemployment insurance (Clause 4, Article%):
The collection and payment of unemployment insurance is carried out along with the collection and payment of compulsory social insurance according to the provisions of the law on social insurance.
