Article 55. Regime and policies for civil servants in leadership and management positions, resignation and dismissal

1. After resigning, civil servants in leadership and management positions who wish to continue working will be considered by competent authorities and assigned to work in accordance with their capacity, strengths, qualifications, expertise, and trained profession. The arrangement of work for civil servants who resign after being disciplined shall be implemented in accordance with the regulations of competent authorities.

2. Civil servants in leadership and management positions after resignation will continue to work if they are retained the leadership position allowance as follows:

a) Receive the current leadership position allowance until the end of the term of office in cases of resignation according to the provisions of Point a, Point b or Point d, Clause 1, Article 52 of this Decree;

b) Receive the current leadership position allowance for 06 months from the date of the resignation decision in cases of resignation according to the provisions of Point c or Point d, Clause 1, Article 52 of this Decree in cases where the term of office is still 06 months or more; in cases where it is less than 6 months, it shall be implemented according to the provisions of Point a of this Clause.

3. Civil servants in leadership and management positions who are dismissed shall not receive position allowances from the date of the dismissal decision. After dismissal, civil servants in leadership and management who wish to continue working will be considered by competent authorities, assigned to do professional work (not leadership and management work) and classified as civil servants in accordance with their job position.

4. After resignation or dismissal, if civil servants voluntarily apply for retirement or quit their jobs, it will be resolved according to current regulations.
