Changing the authority to dismiss Deputy Political Commissar of the Commune-level Military Command

Clause 1, Article 19 of the 2019 Law on Militia and Self-Defense Forces stipulates: The command positions of the Commune-level Military Command, the Military Command of agencies and organizations include:

a) Commander, Political Commissar;

b) Deputy Commander, Deputy Political Commissar.

According to Point d, Clause 1, Article 23 of the Law on Militia and Self-Defense Forces, the Chairman of the District People's Committee decides to appoint command positions of the Commune-level Military Command.

Point d, Clause 1, Article 23 of the Law on Militia and Self-Defense Forces amended by Point b, Clause 11, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates: The Chairman of the Provincial People's Committee decides to appoint command and assistant positions of the Commune-level Military Command.

Clause 2, Article 23 of the 2019 Law on Militia and Self-Defense Forces stipulates:

2. The dismissal of the positions of militia and self-defense commander is regulated as follows:

a) Remove the positions of militia and self-defense forces commanders when changing work positions or changing organizations without the current position or no longer meeting the standards and conditions for performing the current position;

b) The competent authority deciding to appoint a position has the right to decide to dismiss that position.

Thus, before July 1, 2025, the authority to appoint and dismiss Deputy Political Commissar of the Commune-level Military Command belongs to the Chairman of the District People's Committee. From July 1, 2025, this authority belongs to the Chairman of the Provincial People's Committee.
