Rights and obligations of employees according to the 2025 Employment Law
According to the 2025 Employment Law, the rights and obligations of employees in employment are stipulated as follows.
The 2025 Employment Law of the National Assembly, No. 74/2025/QH15, was passed and officially took effect from January 1, 2026.
Accordingly, the rights and obligations of employees in terms of employment are stipulated as follows:
Workers' rights:
a) To have his/her labor registration information protected in accordance with the provisions of law on personal data protection and other relevant legal provisions;
b) Exploiting personal information in the employee database;
c) Be adjusted and updated by competent authorities with labor registration information in the employee database;
d) Use personal information in the database on employees in transactions, access and enjoyment of employment support policies; assessment and issuance of national vocational skills certificates; job consultation, introduction; unemployment insurance according to the provisions of this Law.
Obligations of workers
a) Conduct labor registration according to the provisions of this Law;
b) Providing complete, accurate, honest and timely information on labor registration to competent state agencies, employers and being responsible for the information provided;
c) Timely adjust information in the database on employees when there are changes in information specified in Point c, Clause 1, Article 17 of this Law.
