Converting the minimum monthly salary when paying daily salary
Reader Van Anh asked: According to current regulations on paying daily salaries, how to convert the minimum monthly salary?
Youme Law Firm LLC said that, based on Clause 1, Article 4 of Decree 74/2024/ND-CP, it stipulates:
Applying the minimum wage
1. The monthly minimum wage is the lowest salary as a basis for agreement and salary for employees to apply the form of monthly salary payment, ensuring the salary according to the job or the title of the employee who works normally in normal working time in the month and completing the labor norm or work agreed not to be lower than the minimum salary of the month.
2. The minimum salary is the lowest salary as the basis for agreement and salary for employees to apply the form of hourly salary, ensure the salary according to the job or the title of the employee working for an hour and complete the labor norm or the agreed job must not be lower than the minimum salary.
3. For employees applying the form of weekly or daily salary payment or by product or contract salary, the salary of these forms of salary payment if converted monthly or by hour must not be lower than the minimum monthly or hourly minimum wage. The salary is converted monthly or hourly based on normal working hours chosen by the employer according to the provisions of labor law as follows:
a) The monthly salary is equal to the weekly salary with 52 weeks divided by 12 months; or salary by day multiplied by normal working days in the month; Or the salary according to the product, the contracted salary during normal working hours in the month.
b) The salary is converted by the hour by weekly salary, by day divided by normal working hours of the week, during the day; Or the salary by product, contracted salary divided by working hours during normal working hours to produce products, performing the task.
Accordingly, for employees applying the form of weekly or daily salary payment or by product or contract salary, the salary of these forms of salary payment if converted monthly or by hour must not be lower than the minimum monthly or hourly minimum wage.
The salary is converted monthly or hourly based on normal working hours chosen by the employer according to the provisions of labor law as follows:
Paying daily salary, the daily salary will be converted multiplied by the normal number of working days in the month.
