Regulations on expanding the scope of construction supervision practice certificates Grade II
The unit under the Ministry of Construction has just responded to citizens about the regulation on expanding the scope of the certificate of practice in supervising the construction of grade II traffic works.
On the Ministry of Construction's Information Portal, citizen T.V.D sent a question: "I have been granted a certificate of practice in supervising the construction of a Grade II traffic project according to the provisions of Decree No. 15/2021/ND-CP, valid until March 2028.
According to the provisions of Clause 18, Article 122 of Decree No. 175/2024/ND-CP, how is the content of "In case of expanded scope, it is applied according to the provisions of this Decree" understood?
Can the Certificate of Construction Supervision of Traffic Works Grade II be expanded in scope and scope according to the provisions of Appendix VII of Decree No. 175/2024/ND-CP, to be the head supervisor; supervise construction surveys of works/construction items from level II and below; be the supervisor of construction of all types and levels? ".
After studying, the Department of Economics - Construction Investment Management gave the following opinion:
According to the provisions of Clause 18, Article 122 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government,:
Organizations and individuals who are granted a certificate of capacity and a certificate of practice according to the provisions of the 2014 Construction Law before the effective date of this Decree can continue to use the certificate according to the field and scope of construction activities stated on the certificate until it expires. In case there is a field whose scope is expanded according to the provisions of this Decree, it will be applied according to the provisions of this Decree".
In case the citizen has been granted a certificate of practice in supervising the construction of Traffic works - Grade II, according to the above regulations and the provisions of Section 4.1, Appendix VII of Decree No. 175/2024/ND-CP, the citizen "is allowed to be the head supervisor; supervise the construction of works/construction items from level II and below; be allowed to supervise the construction of all types and levels".
