How do cadres and civil servants who quit their jobs from July 1 enjoy early retirement benefits
Officials and civil servants who retire from July 1, 2025 and enjoy early retirement benefits under Decree 178 must meet the conditions in the Law on Social Insurance 2014.
Section 2 of Official Dispatch 4839/BNV-TCBC in 2025 guides the cases of cadres and civil servants who quit their jobs from July 1, 2025 and enjoy early retirement benefits according to Decree 178/2024/ND-CP amended and supplemented by Decree 67/2025/ND-CP, which must meet the conditions in the Law on Social Insurance 2024, Law on Social Insurance 2014 as follows:
Pursuant to the provisions of Article 7 of Decree 178/2024/ND-CP (amended and supplemented by Decree 67/2025/ND-CP), it is:
Cadres and civil servants subject to the provisions of Article 2 of Decree 178/2024/ND-CP (amended and supplemented by Decree 67/2025/ND-CP) are entitled to early retirement policies when meeting the conditions on age and working time with compulsory social insurance contributions to receive pensions according to the provisions of the law on social insurance at that time.
Accordingly, in the case of retirement from July 1, 2025 (the effective date of the Law on Social Insurance 202), this case is no longer a cadre or civil servant, so the conditions for enjoying the early retirement policy as prescribed in Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP) must be based on the provisions of the law on social insurance before retirement (Child Insurance Law 2014).
