Proposed regulations on department heads and deputy heads under commune-level People's Committees

Youme Law Firm said that the draft decree of the Government stipulates the organization of specialized agencies under the People's Committees of the provinces and cities directly under the Central Government and the People's Committee of the commune, ward and special zones under the provincial level built by the Ministry of Home Affairs and will replace Decree 45/2025 of the Government.

The draft stipulates that each department is assigned 1 full-time leader and manager. In case the Vice Chairman of the Commune People's Committee is also the head of the department, the department will be arranged with 1 deputy head of the department.

The head of the specialized department under the People's Committee of the commune (Head) is appointed by the Chairman of the People's Committee of the commune, responsible to the People's Committee of the commune, the Chairman of the People's Committee of the commune and before the law for performing the functions, tasks and powers of the Division.

Deputy head of the head of the specialized department under the People's Committee of the commune (Deputy Head of the Division) is the head of the Division to direct some working aspects and take responsibility to the Head of the Division for the assigned task.

When the department head is absent, the deputy department head is authorized by the department head to run the department's activities.

The appointment, reappointment, extension of the term of holding leadership and management positions, resignation, dismissal, transfer, rotation, reward, discipline, and implementation of regimes and policies for department heads and deputy department heads shall be decided by the Chairman of the People's Committee at the commune level in accordance with the provisions of law.
