Social insurance informs about the sickness allowance for half a day

Sending a question to the Social Insurance agency, reader N.T.P.L said: "Workers will be off sick on August 8-10, 2025 (according to the discharge notice, hospitalized from 1:00 p.m. on August 8, discharged at 11:00 a.m. on August 10).

I would like to ask, when the sick leave is resolved, the number of days to receive the regime is 3 days or 1 day 9.8, 1.2 days 8.8 and 1/2 days 10.8? Because according to the Social Insurance Law 2024, there is a payment for the half-day sick leave regime".

Regarding this issue, Hanoi Social Insurance responded as follows:

Pursuant to Clause 5, Article 45 of the Social Insurance Law 2024, the 1-day sickness allowance is calculated by dividing the monthly sickness allowance by 24 days.

The sickness allowance for 1/2 day is calculated at half of the sickness allowance for 1 day. When calculating the sickness allowance for employees who are on sick leave for less than a full day, the case of a sick leave of less than 1/2 day is counted as 1/2 day; from 1/2 day to less than 1 day is counted as 1 day.

Because Ms. L did not clearly state whether working hours at the unit are administrative hours or shifts, according to the provisions of the Labor Code, working hours in the morning: 08:00 to 12:00, in the afternoon: 13:00 to 17:00, in her case, she will be paid for 2 days according to regulations.
