Regulations on the Social Insurance Program "Outstanding Enterprises for Workers" 2024

This is a Program to seek and honor businesses that have made continuous efforts to improve the working environment, care about workers' lives, build a harmonious relationship between the interests of businesses, workers' rights and social benefits to move towards sustainable development in the process of integration and development.

The program includes the "Outstanding Enterprise for Workers" Award (organized every 5 years) and the "Outstanding Enterprise for Workers" Ranking (organized annually).

Through 8 rankings and 2 Awards, the program has created a profound social effect, attracting the participation of many businesses and workers; highly appreciated by the leaders of the Party and State. The program has ranked 511 enterprises, awarded Certificates of Merit from the program's organizing agencies to 206 enterprises, 23 enterprises received the "Outstanding Enterprise for Workers" Award, and 20 enterprises have received Certificates of Merit from the Prime Minister.

I. Subject:

All businesses registered to do business in Vietnam, with an operation period of 5 years or more, meeting the following factors can register to participate in the program:

Caring for material and spiritual life, ensuring stable employment, salary, bonus regime, working hours, rest hours and other benefits for workers;

- Strictly implement the provisions of the law on hygiene, labor safety, food safety, social insurance, health insurance, unemployment insurance for employees;

- Having developed, negotiated and signed collective labor agreements, annually reviewing, amending and supplementing them in accordance with the provisions of law and the resolution of the Workers' Conference (if any);

- Well implement the Grassroots Democracy Regulations at the workplace, have issued other regulations and documents directly related to workers;

- Regularly pay attention to investing and improving a green - clean - beautiful working environment;

- Grassroots trade unions in enterprises operate effectively;

- Strictly implement legal regulations related to production and business organization activities of enterprises;

Comply with the provisions of the law on enterprises, investment, labor, land, construction, bidding, environmental protection, food hygiene and safety, occupational safety and hygiene, social insurance, health insurance for employees, etc.;

ally fulfill financial obligations, taxes and other revenues of the state budget according to the provisions of law;

Ensuring stable lives and jobs for workers;

Comply with the provisions of the law on product quality, goods and the law on intellectual property;

"Strictly implement other provisions of the law related to production and business activities of entrepreneurs and enterprises.

II. Time:

- The "Outstanding Enterprise for Workers" Award is presented every 5 years.

- The "Outstanding Enterprise for Workers" ranking is conducted annually.

Sequence of receiving documents and selection:

Enterprises submit application for the program from March 15, 2024 to May 8, 2024 to the Program Organizing Committee ( via email: bxhdoanhnghiep.laodong@gmail.com and by post).

III. How to register to participate:

3.1. Enterprises that complete the dossier include:

Registration form of enterprise (according to form)

Self-assessment scoreboard (according to the set of criteria issued by the Program Organizing Committee): download here

Introducory document of the Provincial/City Labor Federation or the Central Industry Trade Union (if any)

3.2. Enterprises submit the above documents to the Program Organizing Committee:

- send the software via email (file *PDF) to the address bxhdoanhnghiep.laodong@gmail.com, and register online and send the hard copy to the Program Organizing Committee at the end of this regulation.

- The Secretary of the program will answer and discuss questions from the Enterprise via the program's email address

3.3. The Organizing Committee publicly announces on the website: https://bxh.laodong.vn/ of the program the following information:

- Regulations of the Program "Outstanding Enterprises for Workers"

- Application form for the program

- set of criteria for evaluating "Outstanding enterprises for workers 2024

- Information businesses need to know when participating in the program

- List of enterprises selected through each round

3.4. When the enterprise is selected to be ranked annually and awarded the "Outstanding Enterprise for Workers" Award (5 times), the enterprise will receive a written notice from the Program Organizing Committee and receive invitations to attend the program's events such as Press Conference, Seminar, Exchange, Honoring Ceremony...

IV. Selection criteria

4.1. The "Outstanding Enterprises for Workers" ranking is evaluated based on a set of strict criteria developed by labor experts and trade unions. It ensures a close look at the actual situation of use and treatment of employees of the enterprise in terms of income, training, working environment, social welfare and physical and mental training activities of employees.

The set of criteria consists of 2 parts.

* Part A: Conditions for "need" enterprises to be considered and rated: (1) Income of employees increased; (2) no debt/slow salary; (3) no tax debt, (4) no social insurance debt, (5) Having a Trade Union organization, (6) No strike.

* Part B: "Safety" conditions include 9 major targets, divided into many small criteria, with a benchmark score of 100 points; Special attention is paid to the implementation of labor contents of enterprises including: Salary, bonus, benefits, working hours, rest time; social insurance regime; occupational safety and hygiene; Dialogue, negotiation and collective labor agreements; Training and development of labor capacity...

The set of criteria for giving special points to enterprises that provide incentives to employees more than those prescribed by law.

4.2. The "Outstanding Enterprise for Workers" Award selects the best enterprises among the enterprises ranked in the last 5 years based on considering the special and outstanding points of the enterprise in caring for the lives of employees, improving working conditions, and paying attention to building corporate culture. Special priority points are given to enterprises that have been ranked for 5 consecutive years or enterprises with outstanding achievements in caring for the rights of employees, recognized by the Council.

V. Selection process: Method work cycle

1. Pre-sort:

Consider the basic factors of the Enterprise, consider the basic criteria below:

- Increased employee income

- No unpaid wages/lack of wages

- No social insurance debt

- No tax debt

- Having a Trade Union organization

- No strikes

* Enterprises that do not meet one of the above criteria will be eliminated

2. Quotation for consideration of detailed factors of enterprises:

- Divide into 4 scoring groups, organize cross-catching for all entries in round 2. Each group of 2 people in 2 different organizations. Each file must have 2 independent grade groups.

- The Social Insurance Secretary synthesizes the final results; Select the enterprises with the highest scores in round 3

3. The health workers of enterprises that have entered the third round are sent to collect opinions from relevant State management agencies, trade unions and the media. (Each enterprise is given independent opinions by the units):

- Inspection system of local Departments of Labor, Invalids and Social Affairs

- System of Local Labor Federations and Industry Trade Unions

- Enterprises are also allowed to publicly collect opinions from the people and the media. Enterprises with opposing opinions will be specifically considered by the Council before deciding.

- The Organizing Committee can conduct field surveys at some enterprises if the information in the documents provided by the enterprise is not complete.

*Enterprises that do not achieve the level of equality of one of the above units will be eliminated

4. Consideration of the rank of the Decision Council

- Select outstanding enterprises every year to propose the Vietnam General Confederation of Labor, the Ministry of Labor, War Invalids and Social Affairs, and the Vietnam Chamber of Commerce and Industry to award certificates of merit.

- Select outstanding enterprises in the last 5 years to award the "Outstanding enterprise for Workers" award.

VI. Rights and responsibilities of enterprises participating in the program

- Enterprises that are ranked annually receive the Medal of the Program and the Certificate of Rating from the Organizing Committee.

- 30 outstanding enterprises in the Ranking in each field will be awarded Certificates of Merit by the Vietnam General Confederation of Labor, the Ministry of Labor, Invalids and Social Affairs, and the Vietnam Chamber of Commerce and Industry.

- Enterprises that have been ranked for many consecutive years, or have outstanding and outstanding achievements, have the opportunity to be awarded the "Outstanding Enterprise for Workers" Award.

- The "Outstanding Enterprise for Workers 2024" honoring ceremony is expected to be held in the last month of June 2024 in Hanoi; broadcast live on laodong.vn.Enterprises receiving awards and ratings are invited to the stage to receive the program's Certificate of Merit and commemorative medal.
- Enterprises that are ranked and awarded will be invited to join the "Enterprise for Workers" Club with the rights to communicate, recruit, and exchange experiences...
for 01 year from the date of being honored.
- Enterprises are ranked by the Organizing Committee for Promotion and Communications in Lao Dong Newspaper ( print/ electronic version), social networks and mass media.Enterprises registering to participate in the program do not have to pay any fees/fees to the Organizing Committee.

Enterprises are fully responsible for the accuracy of their records.

Enterprises must commit to ensuring full implementation of tax obligations, social insurance, obligations to employees and social responsibility of enterprises towards localities.

- Enterprises are responsible for coordinating to the maximum with the Program Organizing Committee in organizing a survey on the implementation of labor laws in enterprises (if any).

VII. Other regulations

The Organizing Committee does not accept applications sent later than prescribed. The documents provided to the Organizing Committee will not be refunded.

The Organizing Committee will revoke the certificate of merit/reward/medal commemorative award for cases of dishonest discovery or copyright infringement.

In cases where a petition/complaint is sent to the Organizing Committee before the Honoring Ceremony, the enterprise can reserve the voting results until the petition/complaint is resolved.
